The Public Giving Funds Program allows users to invite friends, family, and others to support charitable causes together. These Terms apply when you create or elect to participate in a Public Campaign (defined below) through the GoFundMe Giving Fund (“GFGF”).
1. What is the Public Giving Funds Program?
The Public Giving Funds Program allows certain donor-advised fund (DAF) holders (“Organizers”) to create a personalized giving page or link (a “Public Campaign”) and invite others (“Supporters”) to make third-party contributions to the Organizer DAF. Organizers may generally recommend donations from the pooled DAF contributions to IRS-qualified public charities. All contributions are irrevocably made to GFGF and donation recommendations by Organizers are non-binding on GFGF.
By creating or contributing to a Public Campaign, you agree to these Terms and the GFGF User Agreement and Program Guidelines.
2. How It Works
- The Organizer creates a Public Campaign through their GFGF account. At the time of creation, the Organizer is encouraged to indicate a target date, date range, or other time frame for the frequency of when they intend to recommend donations from the Public Campaign, as this will assist with donor transparency and ensure timely impact of funds raised.
- Supporters may contribute to the Public Campaign. Each contribution is an irrevocable charitable donation to GFGF, to be held for the Organizer’s DAF and related Public Campaign. Contributions are generally tax-deductible to the Supporter.
- All Organizer donation recommendations to IRS-qualified public charities will be subject to GFGF review and the Program Guidelines.
- GFGF retains exclusive legal control over all contributions and final authority over all donation decisions.
3. Irrevocable Contributions
All contributions to a Public Campaign are irrevocable donations to GFGF for charitable purposes. Neither Organizers nor Supporters may reclaim or redirect contributed funds.
Supporters understand:
- Contributions are not payments to the Organizer or any individual.
- No goods, services, or private benefits may be provided in exchange for contributions.
- Contributions and donations cannot be used for any personal benefit, including tuition, memberships, event/gala tickets, or gifts to individuals.
4. Donation Recommendations
Organizers may generally recommend donations to IRS-qualified public charities available through GFGF. By contributing, Supporters acknowledge that:
- They are supporting the Organizer’s advisory privileges and charitable recommendations and have no rights, advisory privileges, or role in the recommendation process.
- No contractual relationship exists between the Supporter and Organizer, or between the Supporter and GFGF, beyond these Terms.
- GFGF is not bound by Organizer recommendations.
- Donations must be made in accordance with GFGF’s Program Guidelines, which may be amended from time to time by its Board of Directors.
5. Supporter Information and Communications
Organizers may receive Supporter names and email addresses (“Supporter Information”) for purposes of administering the Public Campaign, providing updates, and fulfilling legal obligations.
GFGF may provide aggregated or anonymized data to help Organizers assess campaign impact. Organizers must not use Supporter Information for any purpose other than the purposes listed here.
6. Dormant Funds and Use Policy
Our community makes the most impact when DAFs, including Public Campaigns, stay active and in motion. If no donation recommendations are made for twelve months, GFGF will attempt to contact the Organizer. If no donations are made for twenty four months after the last donation activity and the Organizer does not respond, GFGF may revoke the Organizer’s recommendation privileges and transfer remaining funds to a Board-directed GFGF fund for charitable use at the Board’s discretion.
7. Compliance and Enforcement
All donation recommendations are subject to applicable law and GFGF policies. GFGF may, at any time and in its sole discretion, suspend, modify, or revoke any Public Campaign, Organizer designation, or DAF advisory privileges.
8. Modifications and Termination
GFGF may modify these Terms or suspend/terminate the Public Giving Funds Program at any time. Changes will not affect prior contributions.
9. Arbitration
Any disputes arising from these Terms will be resolved through arbitration as described in the Program Guidelines.
10. Governing Law
These Terms are governed by California law, excluding its conflict-of-law rules.
